The export of hazardous waste (as defined in the European Waste catalogue) for recovery/disposal is subject to Waste Management (Transfrontier Shipment of Waste) Regulations, 1998.
These Regulations are for the purposes of giving effect to Council Regulation (EEC) No. 259/93 of 1st February 1993 on the supervision and control of shipments of waste within, into and out of the European Community, as amended.
The Regulations inter alia provide for the designation of competent authorities for the purpose of controlling waste transhipments, powers of competent authorities, the imposition of certain requirements in relation to the shipment of waste into or out of the State, and the prohibition of waste imports by the Environmental Protection Agency.
It is the responsibility of Dublin City Council to oversee all transfrontier shipments of hazardous waste in the country and for the supervision and control of each consignment of hazardous waste exported from Ireland.
The movement of hazardous waste within the state is subject to the provisions of the Waste Management (Movement of Hazardous Waste) Regulations 1998.
The Regulations provide, inter alia, for a system of consignment notes (C1 Forms) in respect of the movement of hazardous waste within the State. They also transpose into Irish legislation certain EU requirements regarding the labeling of waste containers and the mixture of wastes.
Under the regulations Cork City Council is responsible for the supervision and control of movements of hazardous waste originating in its functional area.
Application forms and details of legal requirements in relation to the movement of hazardous waste within the state are available from:
The Waste Management (Facility Permit and Registration) (Amendment) Regulations 2008 - S.I. No. 86/2008 - provide for the granting of waste permits by local authorities in respect of specified waste disposal and recovery activities in lieu of a licence by the Environmental Protection Agency under section 39(1) of the Waste Management Act, 1996.
